The Supreme Court

The Supreme Court is the organ regulating the activity of the courts and tribunals. It ensures the standardization of jurisprudence across the country and oversees the adherence to the law (Article 179 of the Constitution).

The Supreme Court is a court of law and it can be a court of view in the cases determined by law. It exercises control over orders, judgments and rulings relating to the correct application of law and adherence to the forms and rules of procedures (Article 3 of the organic law 11/12 determining the organization, functioning and powers of the Supreme Court).

The Supreme Court was created according to the law n°63-218 in date of June. 18, 1963 under the naming of “Higher Council” which was installed in date of Mar. 02, 1964. It has acquired its financial autonomy since August 12, 1996 and it’s presided by the First President.

The Supreme Court has two (2) structures: judicial and administrative.

The judicial structure is made up of seven chambers: civil chamber, land and property chamber, commercial and maritime chamber, social chamber, family and succession affairs chamber, criminal chamber and offences and infractions chamber in addition to the organ of non-constitutionality, the commission of compensation, the Prosecution general and the clerk of the court’s office.

The Supreme Court Judges and clerks wear an official dress during ordinary and solemn hearings.

The official dress of the Supreme Court Judges consists of a red gown with a closed collar, buttoned up in front, with large facing of black satin from top to bottom at the front, and of large sleeves with a cuff of black satin, and of a red folded bands, and of a red sash ending with an ermine or with a white acrylic. Whereas the official dress of the Supreme Court clerks consists of a black gown with a red folded bands and of large sleeves.
